Sec. 66-1. Screening of junkyards, etc.
(a) It shall be unlawful for any person to operate or have under his control in the county a junkyard, salvage yard or automobile graveyard within 300 feet of the nearest edge of a right-of-way of any highway or roadway in the county unless the junkyard, salvage yard or automobile graveyard is properly screened so that it is not visible from the traveled highway or roadway.
(b) A junkyard, salvage yard or automobile graveyard shall be properly screened when it is not visible from the highways or roadways in the county because of natural objects, plantings, and perennial nature, or fences. The screen shall be such that it blends in with the environment of the area.
(c) The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
(1) Automobile graveyard or salvage yard means any establishment or place of business which is maintained, used or operated for storing buying, keeping or selling wrecks, scrap, ruined or dismantled motor vehicles or motor vehicle parts.
(2) Junk means old or scrap copper, brass, rope, rags, batteries, paper, trash, rubber debris, appliances; waste or junk; dismantled or wrecked automobiles or parts thereof; iron, steel or metal material of any type.
(3) Junkyard means an establishment or place of business which is maintained, operated or used for storing, keeping, buying or selling junk, or for the maintenance or operation of an automobile graveyard or salvage yard, and the term shall include garbage dump and sanitary fields.
(d) All existing businesses, establishments or individuals affected as of the date of June 25, 1991, shall have a period of one year from such date to begin compliance with this section and two years from such date for screening to be completed.
(e) This section is not intended to conflict with any state law now in existence or hereafter in existence. If a conflict does arise, state law will govern.
