ARTICLE I.  IN GENERAL

 

Sec.  34-1. Warrant fee.

 

(a)  The office of the sheriff of the county is empowered to allow any certified law enforcement officer within the county, employed by any official police agency within the county, or any duly elected and qualified constable, to serve warrants of arrest which have been authorized and approved by a magistrate and returned to the office of the sheriff for services.

 

(b)  Upon service of a warrant of arrest by any certified law enforcement officer other than an employee of the sheriff's office, or by a constable, the sheriff shall pay the collected warrant fee of $25.00 to the police department which employees the serving officer.

Sec.  34-2.  Sheriff's petty cash fund.

 

(a)  The county sheriff is authorized to establish a petty cash fund in the amount of  $1,000.00 for emergency expenses.

 

(b)  The petty cash fund shall be reimbursed from the various categories as approved in the county annual budget.

 

(c)  At the end of each fiscal year the Saline County Sheriff will reconcile with the county treasurer with a $0.00 balance and begin each fiscal year with a $1,000.00 balance.

Sec.  34-3.  accounting of drug buy monies.

 

Quarterly accountings of monies for the account of monies used as drug buy monies and rent and utilities in connection with drug enforcement shall be submitted by the sheriff to the budget committee.  Such accounting shall detail the opening balance at the beginning of each quarter, the amount of income, drug buy money returned to the fund, total expenditures for each category, i.e., drug buys, rent utilities, etc., and closing balance on hand.

Sec.  34-4.  Use of excessive force against individuals engaged in non-violent civil rights demonstrations.

 

It shall be the policy of Saline County to ensure that the following are true:

 

(1)  The county has adopted and is enforcing this policy prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any individuals engaged in non-violent civil rights demonstrations.

 

(2)  The county will ensure that all law enforcement agencies within its jurisdiction will enforce all applicable state and local laws against physically barring entrance to or exit from a facility or location which is the subject of such non-violent civil rights demonstrations within its jurisdiction.

 

(3)  In response to non-violent civil rights demonstrations, the county will be mindful and protective of the rights of all participants in such demonstrations, as well as any onlookers, bystanders, or any other persons located in the vicinity owning property in the vicinity.

 

(4)  In connection with such demonstrations, the use of force shall be permitted only when necessary to protect the rights of individuals or to uphold the law.  In no event shall the use of force in excess of that necessary to achieve lawful goals of the county be permitted.

Article II.  JAIL*

 Sec.  34-31.  Jail board.

 

 (a)  Findings.  The quorum court hereby finds and determines:

 

(1)  There exists in the county an urgent need for a new county jail.

 

(2)  It appears that the need for a new jail to serve the county can best be met by utilizing the provisions of County Jail Revenue Bond Act of 1981 (A.C.A. § 12-41-601 et seq.) for the financing thereof.

 

(b)  Creation of board.  In accordance with and pursuant to the authority conferred by the provisions of such act, there is hereby created and established the Saline County, Arkansas Jail Board with authority to accomplish, finance, contract and make loans concerning and otherwise provide for a jail and related and appurtenant facilities to serve the needs of the county.

 

(c) Membership of board.  The board shall consist of the county judge, the sheriff, and the county clerk.

 

(d)  Bonds.  The board is authorized to issue revenue bonds from time to time and to use the proceeds, either alone or together with other available funds and revenues, to provide for the financing of the jail and costs incidental thereto, as set forth in the County Jail Revenue Bond Act of 1981 (A.C.A. § 12-41-601 et seq.).  Such revenue bonds shall be obligations only of the board and shall not constitute an indebtedness for which the faith and credit of the county or any of its revenues are pledged, or for which the state or any of its revenues are pledged.

 

(e)  Other powers.  The board may employ architects and other professionals and shall have all the duties in accordance with the County Jail Revenue Bond Act of 1981 (A.C.A. § 12-41-601 et seq.) and shall carry out its duties in accordance with such act.  The board may adopt bylaws, subject to the disapproval of such bylaws by the court.

 

(f)  Advisory committee.  The quorum court shall serve as an advisory committee to the board.
